Dear Colleague:

Let me ask you if this sounds familiar...

     A client comes to you for a consultation and tells you he owes the IRS $80,000 in unpaid payroll taxes, but little other debt,  from a failed business. The IRS has filed a  levy on his paycheck...

     Another example:  After October 17, 2005 (Bankruptcy Reform) a client has unfiled tax returns for several years.  Before Reform, you would have filed Chapter 13, then filed the taxes and the tax years over 3 years could have been discharged.  No longer.  Bankruptcy Reform requires that the returns be filed at least 2 years before the Bankruptcy to be discharged.    

Bankruptcy won't solve this clients problems.

     What do you do about the taxes? Do you send him or her to another attorney or an accountant? Or do you just tell the client you simply can't help?

     The biggest mistake most attorneys make is underestimating the profitability of helping clients solve their tax problems. 

     The second biggest mistake is believing that since they don't know Tax Law that they can't handle Tax Problem Resolution.  It is not necessary to be understand the nuances of Tax Law to handle Tax Problem Resolution.  In many ways, it is similar to what you already do in your Bankruptcy practice!

     Bankruptcy and Tax Problem Resolution go hand in hand.  We have found that there is a synergy to representing both people with tax problems and those with debt problems.

     Many times we have had clients come in thinking they needed an Offer in Compromise, when what they really needed was a Chapter 13 Bankruptcy.
